　　中新网西宁4月26日电 (祁增蓓)今年4月26日是第24个世界知识产权日。青海省高级人民法院当日召开“持续提升知识产权司法保护水平服务保障青海创新驱动引领高质量发展”新闻发布会，通报2023年该省法院知识产权司法保护状况。

　　创新是引领发展的第一动力，保护知识产权就是保护创新。青海省高级人民法院审委会专职委员齐卫军介绍，2023年，青海法院聚焦“公正与效率”主题，积极履行知识产权审判职能，持续提升知识产权司法保护水平。全年依法新受理各类知识产权案件585件，审结615件(含旧存)。

　　2023年，青海省高级人民法院、青海省人民检察院、青海省公安厅联合印发了《关于对侵犯知识产权刑事案件实行集中管辖的通知》，在全省范围内从机制上全面实现了享有集中管辖权的基层法院受理普通知识产权一审民事、行政及刑事案件，全面实现了知识产权“三合一”审判机制体制改革目标。

　　在依法维护营商环境方面，青海法院充分发挥知识产权司法对保护创新、促进创新的独特作用，依法妥善处理涉互联网文化创作和传播的著作权保护；针对取证难、举证难等情形，结合案情，适时转移举证责任，合理运用举证妨碍排除制度，着力降低维权成本；加强对知识产权批量诉讼中牟利倾向的甄别，统筹考虑关联案件的协调处理，引导批量维权走向源头治理。

　　同时，始终保持打击侵犯知识产权犯罪的高压态势，加大对食品、农业等重点行业、涉民生领域知识产权犯罪的打击力度，有效净化市场环境。

　　“为提高审判效率，弥补法官专业性知识不足，去年，我们联合青海省知识产权局下发《关于决定聘任青海省知识产权技术调查官的通知》，聘任10名技术调查官，降低了查明专门性问题的经济成本。”齐卫军说，为持续优化司法资源配置，青海各级法院实施知识产权类型化案件快审、独任制审判、要素式裁判、示范性判决机制，通过集中审理、流程优化，快速妥善化解纠纷。

　　此外，为总结和发挥青海省知识产权典型案例的示范引领作用，新闻发布会现场还发布了该省在2023年度知识产权司法保护中的5件典型案例，主要涉及著作权和商标知识产权领域。(完)
